Under the Competition and Consumer Act and NCCP regulations, FlexiCommercial is required to undertake an in depth review of a business  who will become a linked credit provider. Therefore, to offer our Consumer lease facility we require details about your business and may require supporting evidence.

Dealer agreement

Agreement Rules

  1. You will not use the FlexiCommercial name, branding, logo or other identification without prior written consent from FlexiCommercial.
  2. You will ensure that you and/or your staff and sales representatives: 
    • do not engage in any false or deceptive conduct in relation to FlexiCommercial;
    • take all reasonable care to ensure the information provided by customers to us is true, complete and accurate;
    • do not mislead customers in any way about the nature or the terms of the customer documentation;
    • observe any other instructions as may be advised to you from time to time;
    • indemnify FlexiCommercial if you provide any false or misleading information to a customer which causes FlexiCommercial to experience any loss.
  3. FlexiCommercial reserves the right to reject or cancel a Dealer registration at any time by giving notice in writing and with immediate effect if:
    • the dealer does not pay its debts when they fall due;
    • ceases to carry on business or undergoes a material change in ownership or control; (c) engages in any prohibited behaviour as described in paragraph 2 above.
  4. Nothing in this Dealer Registration constitutes a relationship of employer and employee, partnership or agent, between us and you or any of your staff or salespeople.
  5. Our confirmation of Dealer registration only permits you to offer FlexiCommercial to commercial customers.
  6. FlexiCommercial may collect commercial credit reports from credit reporting agencies.

    Additional Agreement rules

  7. You will not lease used goods unless refurbished and sold with a minimum 12 month manufacturer’s warranty.
  8. You will not allow a lease where soft costs exceed 30% of the invoice.
  9. You will not lease assets to be affixed to residential or commercial property.
  10. You will not lease goods dependent on you or a third party providing a service integral to the function of that good or where the customer value proposition / sale was based on that service being provided.

Receipt Created Tax Invoice (RCTI Agreement)

This agreement is made between You (supplier) and FlexiCommercial Capital Pty Ltd (‘Recipient’) ABN 93 064 046 046. The purpose of the agreement is for FlexiCommercial Capital Pty Ltd to be authorised to issue “Recipient Created Tax Invoices” for REBATES payable to You (the supplier).

As such it is agreed that:

  • The recipient can issue tax invoices in respect of the supplies.
  • The supplier will not issue tax invoices in respect of the supplies.
  • The supplier acknowledges that it is registered for GST when it enters into the agreement and that it will notify the recipient if it ceases to be registered.
  • The recipient acknowledges that it is registered for GST when it enters into the agreement and that it will notify the supplier if it ceases to be registered for GST or if it ceases

  11. I understand that to be approved as an accredited FlexiCommercial Lease Provider, Flexirent Capital Pty Ltd will, in addition to point6 above, obtain and assess credit report(s) containing my personal credit information.
  12. In accordance with the Privacy Act, I agree that Flexirent may obtain credit report(s) containing information about me (the proprietor/director) from credit reporting agencies for the purpose of assessing my personal and commercial credit worthiness and to exchange information about me with those credit providers named in the credit report(s) for the purpose of assessing my credit worthiness.
